Notification of Application for a Resource Consent under Section 95A(9) of the Resource Management Act 1991

Name of applicant: NBC Projects Limited

Proposal and address: to subdivide Lot 1 DP 489799 into 12 allotments, and to construct eleven townhouses and a stand-alone dwelling with associated earthworks, servicing, landscape planting, and flood management on Rural Zoned land at 25 James Street, Plimmerton, Porirua City.

The applicant proposes:

  • a twelve lot subdivision to provide for 11 houses and an existing Jennian Show Homes office
  • a residential development comprising 10 terraced townhouses (one on each of proposed Lots 2-11) and a single-storey dwelling constructed on pole foundations (on proposed Lot 12)
  • use of the majority of proposed Lot 12 for flood water storage
  • associated earthworks, servicing, and landscape planting
  • cancellation and replacement of a consent notice relating to residential development in a flood prone area.
The application requires land use and subdivision resource consent for the following reasons:
  • the land use part of the proposal includes 11 dwellings and earthworks, neither of which are provided for as permitted activities in the Rural Zone, and which cannot meet the Controlled Activity Standards for dwellings in the Rural Zone.  [Rural Zone Rule D4.1.5(i)]
  • the proposed subdivision includes 12 lots, all of which are under the minimum required area of 5 hectares.  Proposed Lot 1 has an area of 860m2, Proposed Lots 11-11 range in area between 240m2 and 285m2, and Proposed Lot 12 has an area of 7,360m2.  [Rural Zone Rule D4.1.5(v).

The proposed Subdivision and Land Use components of the proposal are a Non-Complying Activity under the Operative Porirua City District Plan.  The proposed amendment to the Consent Notice under Section 221(3) of the Resource Management Act 1991 (the Act) is a Discretionary Activity under Section 127(3)(a) of the Act.

The application includes an assessment of environmental effects which covers flooding and other related land development matters, a copy of resource consents for the proposed earthworks granted by Greater Wellington Regional Council (Reference: WGN180051), and written approval to the proposal provided by the New Zealand Transport Agency.

The application may be inspected at the Porirua City Council, Customer Services Centre at 16 Cobham Court, Porirua City, between the hours of 8am and 5pm, or below.

Who can make a submission?

Any person may make a submission on the application, but a person who is a trade competitor of the applicant may do so only if that person is directly affected by an effect of the activity to which the application relates that:

(a) adversely affects the environment; and

(b) does not relate to trade competition or the effects of trade competition.
