Notification of Application for a Resource Consent under Section 95A(1)& 95A(9)
Name of Applicant: Geoff Wallace - Inlet Sunsets Limited
Proposal & Address: To subdivide Lots 4 and 5 DP 69567 into six residential allotments with a further lot to be vested as legal road, and to construct a gospel hall with associated earthworks for flood management, servicing and landscape planting on Rural Zoned land at 39 Paekakariki Hill Road, Pauatahanui, Porirua City (located on the intersection of Paekakariki Hill Road and Grays Road), proposal as follows:
Subdivision consent to create six lots ranging in size between 790m2 and 2,600m2 and 35m2 of legal road to vest. No new dwellings are proposed under this application, only design requirements under s221 consent notices on proposed Lots 1-5. New vehicle crossings will be formed on both road frontages of the site. Land use consent is sought for a single-storey 96m2 gospel hall on proposed Lot 6, and earthworks to import approximately 7,700m3 of fill to raise the site by 1m to address the 1% AEP flood event, together with services and a swale drain to treat and store stormwater from the site and adjoining road area. Landscape mitigation planting is proposed.
The overall proposal is assessed as a Non-Complying Activity under the Porirua City Operative District Plan. The proposed lots are all under the minimum required area of 5 hectares within the Rural Zone (Rule D4.1.5(v)). The construction and use of a gospel hall and associated earthworks are not provided for as a permitted activity in the Rural Zone, and the proposed building cannot meet the Controlled Activity Standards for buildings (car parking, and yard setbacks (Rule D4.1.5(i)). The proposed new vehicle crossings require consent as a Controlled Activity (Rule
D4.1.2(iv)). The applicant has requested the Council to publicly notify the application pursuant to Section 95A(3) of the Resource Management Act (1991).
Any person may make a submission on the application, but a person who is a trade competitor of the applicant may do so only if that person is directly affected by an effect of the activity to which the application relates that—
(a) adversely affects the environment; and
(b) does not relate to trade competition or the effects of trade competition.
