DECISIONS MADE THROUGH ADOPTION

Thank you to those that made a submission on the Proposed Reserve at Porirua Stream Esplanade consultation.

The Council considered all feedback as part of their deliberations on Thursday 2 December 2021, and agreed to:

  • Declare and classify Section 1 SO 552663 and Section 2 SO 552663 as Local Purpose (Esplanade) Reserve by notice in the New Zealand Gazette, in accordance with section 14(4) of the Reserves Act 1977

The Proposal

In 2017, the land described as Section 1 SO 552663 and Section 2 SO 552663, at Kenepuru Drive, Kenepuru was agreed by the Council to be acquired in a land exchange with Waka Kotahi/New Zealand Transport Agency as part of the Transmission Gully Motorway project.

The Land was acquired as fee simple land and is therefore not currently held as reserve. In order for the land to be managed as reserve under the Reserves Act 1977 it needs to be declared as reserve under section 14 of the Act and classified as Local Purpose Reserve (Esplanade). It is proposed to incorporate the land into the surrounding Porirua Stream Esplanade Reserves.

Section 23 of the Act states that local purpose reserves are for the purpose of providing and retaining areas for such local purpose or purposes as are specified in any classification of the reserve. In this case, the Land proposed to be declared and classified is for esplanade purposes.

If submission on this proposal are received these must be considered before a decision is made on whether the land should be declared as reserve and classified as Local Purpose Reserve (Esplanade).
